Various Supreme Court rulings have affirmed that offering games of skill is a fundamental right under the Indian Constitution, meaning such games cannot be prohibited. The High Courts of Karnataka and Calcutta have ruled that law enforcement agencies cannot interfere with poker games.
Considering this legal precedent, many legal experts and jurists have concluded that online poker is legal in India.
